TERMS AND CONDITIONS OF SALE

SAINT CHARBEL SHOP

1. CONTRACT

By placing an order online with SAINT CHARBEL SHOP (hereinafter “SAINT CHARBEL SHOP”, “we”, or “us”), you (hereinafter the “buyer”, “you”, or “your”) acknowledge and agree that these Terms and Conditions of Sale (hereinafter the “Terms”) constitute a legally binding contract governing the purchase of products (hereinafter the “products”).

2. PRICE

All prices are indicated in United States currency. Prices may be modified at any time without prior notice. The price applicable to an order is the price in effect at the time the order is placed.

3. TAXES, DUTIES, AND DELIVERY FEES

Product prices exclude all applicable taxes, customs duties, brokerage fees, transportation costs, delivery fees, and any other charges related to the shipment and importation of the products.
All such fees remain the sole responsibility of the buyer, including any fees arising from international shipments or export outside Canada.

4. DELIVERY

Products are shipped through third-party carriers to the delivery address provided by the buyer. SAINT CHARBEL SHOP is not responsible for errors, omissions, or inaccuracies in the delivery information provided by the buyer.

Products are handed over to the carrier within a reasonable timeframe following payment confirmation. All delivery times provided are estimates only and are not guaranteed.

Once the shipment is transferred to the carrier, risk of loss, delay, or non-delivery passes entirely to the buyer, subject to applicable law.

5. FAILED DELIVERY, RETURN TO SENDER, AND NON-DELIVERY

If a shipment cannot be delivered due to reasons attributable to the buyer, including but not limited to:

  • Recipient unavailability

  • Absence of a required contact phone number

  • Failure to respond to the carrier

  • Incorrect or incomplete address

  • Refusal of delivery

  • Failure to pay customs duties or import charges

the shipment may be held, abandoned, or returned to SAINT CHARBEL SHOP by the carrier.

In such cases:

  • No refund shall be issued for the products or shipping fees.

  • Original shipping costs are non-refundable.

  • Return shipping costs, customs fees, and carrier charges may be deducted or invoiced to the buyer.

  • SAINT CHARBEL SHOP may, at its sole discretion, offer reshipment at the buyer’s expense once the products are returned.

A return to sender caused by failed delivery does not constitute a valid return under these Terms.

6. RETURNS AND REFUNDS

Products may only be returned within five (5) days from the date of receipt by the buyer.

Returned products must:

  • Be unused

  • Be in their original packaging

  • Be returned in resalable condition

Return shipping costs are the sole responsibility of the buyer and are non-refundable.

Refunds, if applicable, will be processed only after receipt and inspection of the returned product and will exclude all shipping, handling, customs, and return-related costs.

No refund will be issued for products that were not successfully delivered due to buyer-related delivery issues.

7. DAMAGED OR INCOMPLETE SHIPMENTS

If a product arrives damaged or incomplete, the buyer must notify SAINT CHARBEL SHOP within seventy-two (72) hours of receipt.

All claims require prior written approval. If accepted, SAINT CHARBEL SHOP may replace the product or, if replacement is not possible, issue a refund limited to the product value only.

8. ORDER MODIFICATIONS OR CANCELLATIONS

All order changes or cancellations must be submitted in writing and approved by SAINT CHARBEL SHOP. Orders that have already been shipped cannot be cancelled.

9. PRODUCT AVAILABILITY

Product availability is not guaranteed. SAINT CHARBEL SHOP reserves the right to cancel an order due to stock unavailability and issue a refund for the product value only.

10. PERSONAL INFORMATION

The buyer consents to the collection, use, storage, and disclosure of personal information necessary for order processing, payment, delivery, customer service, and legal compliance.
Personal information may be processed or stored outside Quebec or Canada.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, SAINT CHARBEL SHOP shall not be liable for indirect, incidental, or consequential damages.
In all cases, SAINT CHARBEL SHOP’s total liability shall not exceed the amount paid by the buyer for the product.

12. EXPORT AND REGULATORY COMPLIANCE

The buyer is solely responsible for ensuring that the products comply with all applicable laws, regulations, and import requirements in the destination country.
SAINT CHARBEL SHOP shall not be held liable for any fines, seizures, delays, or refusals arising from export or import regulations.

13. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Province of Quebec, Canada.
The parties submit to the exclusive jurisdiction of the courts of the Province of Quebec.
The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

14. SEVERABILITY, NON-WAIVER, AND INTERPRETATION

If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force.
No waiver shall be effective unless in writing and signed by an authorized representative of SAINT CHARBEL SHOP.
